- It is a developing legislation program with the main objective of discouraging citizens from littering, which is expected to be implemented within 2024.

- It paves the way households will manage their waste, mobilizing citizens to recycle and avoid sending waste to landfills.

- The fees will be based on the actual amount of waste produced.

- Municipalities will be able to charge lower council rates to everyone who produces less waste or recycles more.

- Citizens will be asked to adopt a new philosophy regarding production and recycling waste, as the more waste is sent to the landfills the more fees they will be forced to pay.

2024 new data

In Greece the relevant legislation will be implemented for all Municipalities with a population of more than 100,000 inhabitants from 01/01/2023 and for Municipalities with a population of more than 20,000 inhabitants from 01/01/2028.

The green transition, recycling reinforcement and the government's aim to end the country's EU waste fines, all mean that in the coming months municipalities will need to get the infrastructure in place to implement the new measure.

So far, the program will start to be implemented on a smaller scale in several municipalities of the country, starting with the big waste producers. Large waste producers (such as hotels, restaurants, hospitals and shopping centers) are benefited more with the implementation of the new legislation.

Establishment of the “Pay-as-you-throw model” (Article 14 of Directive 2008/98/EC as amended by paragraph 4 of article 1 and paragraph 15 of article 1 of Directive (EU) 2018/851)

Article 1 of Law 25/1975 (A'74), Article 1a is added as follows:

«Article 1a: Establishment of “Pay-as you-throw” model»:

1. The “Pay-as-you-throw” is a model whereby waste producers are charged based on the actual amount of waste they produce. With the application of the model, the calculation of a uniform remunerative cleaning fee will be done based on waste production per household or building complex, professional activity and urban/municipal unit (provided the Local Government Organizations possess systems for calculating the waste produced). Application of the model is chosen and, in addition to the coefficients of article 1, the following are determined:
a) the waste for which the present system applies,
b) the determinable of those liable to pay the fee,
c) the units of measurement and the corresponding unit value (which may vary by waste category),
d) the ratio of the retributive fees is calculated (in accordance with Article 1) in relation to the calculation based on waste production,
e) calculating, collecting and returning fees are calculated based on the waste produced and
f) any other matter related to the implementation of the present system.

2. From 01/01/2023, grade A Local Government Organizations (LGO’s), with a population of over twenty thousand (20,000) inhabitants are hereby obliged to apply the system for the biological waste produced, according to the article 50, who become liable for the return of the fee. To implement this legislation, grade A LGO’s:
a) are required to have a system for measuring the biological waste produced (according to article 50).
b) follow the prescribed orders (in accordance with paragraph 1 (par.1)).

3. From 01/01/2023, grade A LGO’s, main hotel accommodations of more than one hundred (100) beds and industrial facilities operating within the limits of their competence (including poultry breeding facilities), are obliged to apply the legislation of par. 1 for municipal waste produced by complex tourist accommodations (Law 4276/2014, par. 2, 1st article). To implement this legislation, grade A LGO’s:
a) are required to have a system for measuring the biological waste produced (according to article 50).
b) follow the prescribed orders (in accordance with paragraph 1 (par.1)).

4. From 01/01/2028, grade A LGO’s with a population of more than twenty thousand (20,000) inhabitants are obliged to apply the system of par.1. To implement this legislation, grade A LGO’s:
a) are required to have a system for measuring the biological waste produced (according to article 50).
b) follow the prescribed orders (in accordance with paragraph 1 (par.1)).
